TERMS AND CONDITIONS – EU CROSS-BORDER VERSION

(For distance sales within the European Union)

The company sells goods within the European Union under the EU VAT OSS scheme.

2. Scope of Application

These Terms and Conditions apply to all contracts concluded at distance between ROMEXTRUD INTERNATIONAL SRL and consumers or professionals located within the European Union.

Consumers benefit from the mandatory consumer protection provisions applicable in their country of residence, in accordance with Regulation (EC) No 593/2008 (Rome I).

3. Product Information

The products sold are compatible spare parts unless explicitly stated otherwise.
They are not original manufacturer parts unless expressly indicated.

Images are for illustrative purposes only and may contain accessories not included in the standard package.

4. Order Process

Orders are placed through the website.
A contract is concluded once the customer receives order confirmation.

The seller reserves the right to refuse orders in justified cases (stock errors, pricing errors, suspected fraud).

5. Prices and VAT

Prices are displayed including VAT applicable under EU OSS rules.

Shipping costs are calculated automatically at checkout depending on delivery country, weight and size.

For parcels exceeding 30 kg, additional shipping charges may apply.

6. Delivery

Orders are usually processed within 1–2 business days.
Delivery time within the EU generally ranges between 2–7 working days depending on destination.

Risk transfers to the consumer upon delivery.

7. Right of Withdrawal (Directive 2011/83/EU)

Consumers have the right to withdraw from the contract within 14 days without giving any reason.

The withdrawal period expires 14 days after the day on which the consumer acquires physical possession of the goods.

Returns must be sent without cash-on-delivery.

Return shipping costs are borne by the consumer unless the product is defective or not as described.

Refunds are processed within 14 days from receipt of the returned goods.

The following cannot be returned:

  • Products with clear signs of use beyond necessary inspection

  • Products damaged due to improper handling

  • Sealed goods unsealed after delivery where hygiene reasons apply

  • Custom-made goods

8. Legal Guarantee (Directive 2019/771/EU)

Consumers benefit from a 2-year legal conformity guarantee across the EU.

The warranty covers lack of conformity existing at delivery.

The consumer may request:

  • Repair

  • Replacement

  • Price reduction

  • Contract termination (where applicable)

Installation carried out by the consumer does NOT automatically void the legal guarantee.

However, damage caused by incorrect installation not due to defective instructions is not covered.

For professional customers (B2B), the warranty period is 12 months unless otherwise agreed.

Batteries and accumulators: 6 months commercial warranty (without limiting legal rights).

9. Exclusions from Warranty

The warranty does not cover:

  • Normal wear and tear

  • Consumables

  • Damage caused by improper use

  • Use of incorrect fuels or oils

  • Unauthorized repairs

  • Mechanical shocks or improper storage

  • Modifications to the product

These exclusions do not affect mandatory EU consumer rights.

10. Liability

The seller is liable in accordance with applicable EU consumer law.

Liability is limited to foreseeable damages typical for the contract.

Nothing in these terms excludes liability for:

  • Death or personal injury

  • Fraud

  • Gross negligence

  • Mandatory consumer rights

11. Online Dispute Resolution

Consumers may use the European Commission’s ODR platform:

12. Governing Law

Romanian law applies.

However, consumers residing in another EU Member State retain the protection of mandatory provisions of their country of residence.
